Terms of Service

By accessing or using Bottl.Service (bottlservice.com), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree to these terms, you may not use the platform. These Terms constitute a legally binding agreement between you and Resilient Spirits LLC ("Resilient Spirits," "we," "us," or "our").

YOU MUST BE 21 YEARS OF AGE OR OLDER TO USE BOTTLSERVICE. By using this platform, you represent and warrant that you are at least 21 years of age. We reserve the right to refuse service, terminate accounts, or cancel orders if we have reason to believe a user is under 21 years of age. Illinois law requires adult signature upon delivery of all alcoholic beverage orders.

Technology Platform

Bottl.Service is a technology and fulfillment platform operated by Resilient Spirits LLC. We do not sell alcoholic beverages directly.

Licensed Retailer

All alcoholic beverage sales are made by Famous Wine & Spirits (Ghotra Spirits LLC), a licensed Illinois retail dealer (License #1A-1147301 / #1A-1146816) located in Decatur, Illinois. Your purchase constitutes a transaction with Famous Wine & Spirits as the retailer of record.

Delivery Area

Delivery is available within the State of Illinois only. Orders may not be shipped to addresses outside of Illinois. We reserve the right to refuse delivery to certain areas at our discretion.

Order Acceptance

Placing an order does not constitute a binding contract until we confirm acceptance. We reserve the right to refuse or cancel any order for any reason, including product unavailability, pricing errors, or suspected fraud.

Pricing

All prices are displayed in U.S. dollars and are subject to change without notice. Prices include applicable product costs but exclude shipping and applicable taxes, which will be calculated and displayed at checkout.

Pre-Orders

For pre-order items, a 50% deposit is charged at the time of order. The remaining 50% will be charged when your order ships. Pre-order deposits are non-refundable except as required by law or if we are unable to fulfill the order. Estimated ship dates are estimates only and are subject to change. Pre-order payment methods are securely saved at checkout using Stripe's off-session payment infrastructure. The remaining balance will be automatically charged to your saved payment method when your order ships. If the automatic charge fails, you will receive a payment link via email to complete your purchase.

Payment Processing

Payments are processed by Stripe, Inc. By providing payment information, you authorize us to charge the applicable amount to your payment method. You represent that you are authorized to use the payment method provided.

All orders require an adult signature (21+) upon delivery as required by Illinois law. If no eligible adult is available to sign at the time of delivery, the package will not be left unattended and a re-delivery attempt will be made. Additional re-delivery fees may apply. Bottl.Service and Famous Wine & Spirits are not responsible for failed deliveries due to the absence of an eligible adult recipient. Shipping costs are calculated at checkout based on the weight and dimensions of your order using live carrier rates from UPS and FedEx. In the event that live carrier rates are temporarily unavailable, a flat shipping rate of $19.99 will be applied.

Subscription Program

Bottl.Service offers a Subscribe & Save program that allows you to schedule recurring deliveries of eligible products at a per-product discount. The applicable discount is shown on each eligible product. By enrolling a product in Subscribe & Save, you authorize us to charge your saved payment method automatically at the selected interval (monthly, every 6 weeks, or every 2 months) until you cancel.

Billing & Charges

Subscription charges are processed automatically on your next charge date using the payment method on file. You will receive an email notification before each charge. If a charge fails, we will attempt to notify you and may retry the charge. Subscriptions with repeated payment failures may be paused or cancelled.

Cancellation & Modifications

You may cancel or modify your subscription at any time through your account page at /account. Cancellations take effect before the next scheduled charge date. No refunds are issued for charges that have already been processed. You may delay a scheduled delivery by up to 30 days through your account page.

Product Availability

If a subscribed product goes out of stock at the time of your scheduled delivery, your subscription will be automatically paused and will resume when the product is back in stock. You will be notified by email. Subscriptions are subject to a 30-day cooldown period after each successful charge before a new subscription for the same product can be placed.

Due to the nature of alcoholic beverages and Illinois liquor regulations, all sales are final. We do not accept returns of alcoholic beverage products. If your order arrives damaged or incorrect, please contact us at orders@distryb.com within 48 hours of delivery with photos of the issue. We will work with you to resolve the matter, which may include a replacement or store credit at our discretion.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or are associated with abuse of the platform. Usernames may be changed no more than once every 14 days.

You agree not to: use the platform if you are under 21 years of age; purchase alcohol on behalf of anyone under 21; resell products purchased through Bottl.Service; use automated means to access or scrape the platform; attempt to circumvent any security measures; provide false information including false age verification; or use the platform for any unlawful purpose.

All content on Bottl.Service, including but not limited to text, graphics, logos, button icons, images, and software, is the property of Resilient Spirits LLC or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the platform without our express written permission.

BOTTLSERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. TO THE FULLEST EXTENT PERMITTED BY ILLINOIS LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RESILIENT SPIRITS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF BOTTLSERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless Resilient Spirits LLC, Famous Wine & Spirits, DISTRYB, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of Bottl.Service, your violation of these Terms, or your violation of any applicable law or regulation.

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of Bottl.Service shall be resolved exclusively in the state or federal courts located in Illinois. You consent to the personal jurisdiction of such courts.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the effective date at the top of this page and, where appropriate, notifying you by email. Your continued use of Bottl.Service after changes are posted constitutes your acceptance of the revised Terms.
