Terms of Service

By accessing or using Bottl.Service (bottlservice.com), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree to these terms, you may not use the platform. These Terms constitute a legally binding agreement between you and Resilient Spirits LLC dba DISTRYB ("DISTRYB," "we," "us," or "our").

YOU MUST BE 21 YEARS OF AGE OR OLDER TO USE BOTTLSERVICE. By using this platform, you represent and warrant that you are at least 21 years of age. We reserve the right to refuse service, terminate accounts, or cancel orders if we have reason to believe a user is under 21 years of age. Applicable state law requires adult signature upon delivery of all alcoholic beverage orders.

Technology Platform

Bottl.Service is a technology and fulfillment platform operated by Resilient Spirits LLC. We do not sell alcoholic beverages directly.

Licensed Retailer

All alcoholic beverage sales are made by licensed retailers in your state. Your purchase constitutes a transaction with the licensed retailer of record in your delivery area.

Delivery Area

Delivery is available where licensed. We reserve the right to refuse delivery to certain areas at our discretion based on licensing and regulatory requirements.

Order Acceptance

Placing an order does not constitute a binding contract until we confirm acceptance. We reserve the right to refuse or cancel any order for any reason, including product unavailability, pricing errors, or suspected fraud.

Pricing

All prices are displayed in U.S. dollars and are subject to change without notice. Prices include applicable product costs but exclude shipping and applicable taxes, which will be calculated and displayed at checkout.

Pre-Orders

For pre-order items, a 50% deposit is charged at the time of order. The remaining 50% will be charged when your order ships. Pre-order deposits are non-refundable except as required by law or if we are unable to fulfill the order. Estimated ship dates are estimates only and are subject to change. Pre-order payment methods are securely saved at checkout using Stripe's off-session payment infrastructure. The remaining balance will be automatically charged to your saved payment method when your order ships. If the automatic charge fails, you will receive a payment link via email to complete your purchase.

Payment Processing

Payments are processed by Stripe, Inc. By providing payment information, you authorize us to charge the applicable amount to your payment method. You represent that you are authorized to use the payment method provided.

All alcoholic beverage orders are provided by a licensed retailer in your state through in-store pickup or local delivery within that state — there is no cross-state shipping of spirits. Any delivery of alcohol requires an adult signature (21+) as required by applicable state law. If no eligible adult is available at the time of delivery, the order will not be left unattended and a re-delivery or re-pickup arrangement will be made; additional fees may apply. Bottl.Service and its licensed retail partners are not responsible for failed deliveries due to the absence of an eligible adult recipient. For any items that ship (such as non-alcoholic products), shipping is calculated at checkout using live carrier rates from UPS and FedEx; if live carrier rates are temporarily unavailable, a flat shipping rate of $19.99 will be applied.

Subscription Program

Bottl.Service offers a Subscribe & Save program that allows you to schedule recurring deliveries of eligible products at a per-product discount. The applicable discount is shown on each eligible product. By enrolling a product in Subscribe & Save, you authorize us to charge your saved payment method automatically at the selected interval (monthly, every 6 weeks, or every 2 months) until you cancel.

Billing & Charges

Subscription charges are processed automatically on your next charge date using the payment method on file. You will receive an email notification before each charge. If a charge fails, we will attempt to notify you and may retry the charge. Subscriptions with repeated payment failures may be paused or cancelled.

Cancellation & Modifications

You may cancel or modify your subscription at any time through your account page at /account. Cancellations take effect before the next scheduled charge date. No refunds are issued for charges that have already been processed. You may delay a scheduled delivery by up to 30 days through your account page.

Product Availability

If a subscribed product goes out of stock at the time of your scheduled delivery, your subscription will be automatically paused and will resume when the product is back in stock. You will be notified by email. Subscriptions are subject to a 30-day cooldown period after each successful charge before a new subscription for the same product can be placed.

Due to the nature of alcoholic beverages and applicable state liquor regulations, all sales are final. We do not accept returns of alcoholic beverage products. If your order arrives damaged or incorrect, please contact us at orders@distryb.com within 48 hours of delivery with photos of the issue. We will work with you to resolve the matter, which may include a replacement or store credit at our discretion.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or are associated with abuse of the platform. Usernames may be changed no more than once every 14 days.

You agree not to: use the platform if you are under 21 years of age; purchase alcohol on behalf of anyone under 21; resell products purchased through Bottl.Service; use automated means to access or scrape the platform; attempt to circumvent any security measures; provide false information including false age verification; or use the platform for any unlawful purpose.

Automated Access & Data Extraction

The DISTRYB Licensing Directory and other public reference pages are provided for individual reference and for indexing by search engines and AI answer engines that respect our published robots.txt. Except as expressly permitted there, you may not: (a) use any automated means — including bots, scrapers, crawlers, headless browsers, or scripts — to access, extract, copy, or index the Directory in bulk or in any manner that builds, populates, trains, or supplements a database, product, or service; (b) reproduce, redistribute, sell, license, or create derivative datasets from all or a substantial part of the Directory or its compilation; or (c) circumvent, disable, or exceed any rate limit, access control, or other technical protection measure. Programmatic or bulk access is available only under a separate written data-license or API agreement — contact us to arrange it.

All content on Bottl.Service, including but not limited to text, graphics, logos, button icons, images, and software, is the property of Resilient Spirits LLC or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the platform without our express written permission.

Directory Compilation

Individual permit and license records in the DISTRYB Licensing Directory derive from public government sources. However, the selection, arrangement, normalization, cross-jurisdiction matching, and enrichment of those records — the compilation as a whole — is the proprietary work product of Resilient Spirits LLC dba DISTRYB, protected as a compilation and provided under license subject to these Terms. Nothing in these Terms grants any right to the compilation beyond the individual, non-automated reference use permitted above.

BOTTLSERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Disclaimer of Indirect Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RESILIENT SPIRITS LLC, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, BOTTLSERVICE.

Platform & Alcohol Disclaimers

BOTTLSERVICE OPERATES SOLELY AS A TECHNOLOGY PLATFORM AND DOES NOT MANUFACTURE, DISTRIBUTE, SELL, OR DELIVER BEVERAGE ALCOHOL. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE ASSUME NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ACTS, OMISSIONS, OR NEGLIGENCE OF ANY RETAILER, COURIER, DRIVER, OR OTHER THIRD PARTY; (II) FAILURE BY ANY RETAILER OR COURIER TO VERIFY THE AGE OR INTOXICATION LEVEL OF ANY CONSUMER; (III) PERSONAL INJURY, PROPERTY DAMAGE, OR DEATH RESULTING FROM THE PURCHASE, DELIVERY, OR CONSUMPTION OF ALCOHOLIC BEVERAGES OBTAINED THROUGH THE PLATFORM; (IV) VIOLATIONS OF ANY FEDERAL, STATE, OR LOCAL ALCOHOL BEVERAGE CONTROL LAWS BY RETAILERS, DISTRIBUTORS, OR PRODUCERS; OR (V) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS OR ANY INFORMATION STORED THEREIN.

Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE AGGREGATE LIABILITY OF RESILIENT SPIRITS LLC EXCEED THE GREATER OF (I) THE TOTAL AMOUNTS YOU PAID TO RESILIENT SPIRITS LLC FOR THE SERVICES DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (II) ONE HUNDRED U.S. DOLLARS ($100.00).

Application & Exceptions

THIS SECTION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF RESILIENT SPIRITS LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY FOR FRAUD, GROSS NEGLIGENCE, OR INTENTIONAL MISCONDUCT WHERE PROHIBITED BY APPLICABLE LAW.

You agree to indemnify, defend, and hold harmless Resilient Spirits LLC, its licensed retail partners, DISTRYB, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of Bottl.Service, your violation of these Terms, or your violation of any applicable law or regulation.

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of Bottl.Service shall be resolved exclusively in the state or federal courts located in Cook County, Illinois. You consent to the personal jurisdiction of such courts.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the effective date at the top of this page and, where appropriate, notifying you by email. Your continued use of Bottl.Service after changes are posted constitutes your acceptance of the revised Terms.
